The FMCSA announced it wants permission to collect information about these CDLs for three years.

The agency wants states to keep all paperwork related to these licenses for at least two years after they are given out, changed, or renewed. If states don’t keep these records, it’s hard for the FMCSA to check if the licenses were given out correctly.

In September 2025, the FMCSA made a temporary rule to take charge of these CDLs because some states allowed many unqualified or illegal drivers to get them. The FMCSA said this rule would cancel about 194,000 licenses.

The rule started right away, but it was stopped by a lawsuit. The court said the FMCSA should look at public comments and make a final rule. The FMCSA must now update the court every 90 days, starting March 3.

The FMCSA still wants full permission to collect information for three years so it can start as soon as the court allows or when the final rule is ready.

People could comment on the temporary rule until November 28, 2025. The FMCSA got over 8,000 comments and will use these to create the final rule
